2. Privacy and data protection policy

In accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), the personal data you provide through this website will be processed by Venta de Posa as Data Controller.

Purpose of processing and data collected

  • Contact forms: We process your name, surname and email address solely to manage and respond to your inquiries, requests for information or suggestions.
  • Blog comments: We process your name and email address to manage the publication of your comments.
  • Booking management: We process your name, surname, phone number, email address and bank card details.
    Note on payments and guarantees: Your bank card details are requested solely as a booking guarantee and are managed in encrypted and complete form through the external platform The Fork (La Fourchette España S.L. / Bookatable España S.L.), which acts as Data Processor under strict security standards (PCI-DSS). Venta de Posa does not store, view or process this bank data in its own systems.

Legal basis

The legal basis allowing us to process your data varies depending on the channel used:

  • Contact and comments: The user’s express consent given by ticking the acceptance box before submitting the form.
  • Booking management: The performance of a contract or the application of pre-contractual measures to which the user is a party.
  • Legal obligations: Compliance with applicable tax, accounting and consumer regulations.

Recipients and international transfers

Your data will not be shared with third parties, except where legally required or with the following providers necessary for the provision of the service:

  • The Fork (La Fourchette España S.L. / Bookatable España S.L.)): As data processor for the technical management of bookings.
  • Google LLC (Google Analytics): For statistical analysis of the website. This service may involve the international transfer of data to the USA, which is fully regularized as Google is adhered to the EU-US Data Privacy Framework and through the signing of Standard Contractual Clauses (SCCs).

Data retention period

  • Contact and comment data: Will be kept for as long as you do not request its deletion or withdraw the consent given.
  • Booking data: Will be kept for the duration of the relationship and, thereafter, will remain blocked during the legal limitation periods (generally up to 6 years for tax and commercial obligations).
  • Analytics data: Browsing data managed by Google Analytics will be kept for a maximum period of 14 months (adapted to the current standard limits of Google Analytics 4).

User rights

You may exercise your rights of access, rectification, erasure, restriction of processing, objection and portability of your data at any time. To do so, you must send a written request, accompanied by a copy of your ID document or equivalent, to:

Minors

This website is not directed at minors under 14 years of age. We do not knowingly collect data from minors of this age. If we detect that a minor under 14 has provided us with personal data, we will proceed to delete it immediately from our systems.

4. Terms of contracting and bookings

Use of the booking system implies full acceptance of the following terms:

  • Confirmation: Every booking requested through the platform is subject to receipt of a confirmation email or SMS sent automatically by the system.
  • Changes: Any change in the number of guests, date or time must be communicated as far in advance as possible, directly to the restaurant by phone or through the available channels.

Cancellation policy and penalties

  • Cancellation of a booking is completely free of charge if made more than 24 hours in advance of the reserved time.
  • If the cancellation is made within the last 24 hours, or in the event of a no-show, Venta de Posa reserves the right to charge €20 per guest to the credit/debit card provided during the booking process, as a management and table-blocking fee.

5. Applicable law and jurisdiction

This Legal Notice and the relationships arising from it are governed in all respects by Spanish law.
For the resolution of any dispute arising from the use of the website or the booking services, the parties submit to the Courts of the consumer’s (user’s) place of residence. Should the user act as a business or reside outside Spanish territory, the parties expressly waive any other jurisdiction that might apply to them and submit to the Courts of Alicante.
